Federal and State Exclusion Lists

List of Excluded Individuals/Entities (LEIE)

A nurse who has received a disciplinary order from the Texas Board of Nursing may appear on the U.S. Department of Health and Human Services’ List of Excluded Individuals/Entities (LEIE).  The U.S Department of Health and Human Services’ Office of Inspector General (OIG) may exclude individuals and entities from federally funded health care programs under certain conditions.  There are many reasons an individual may be placed on the LEIE, including state licensure actions.  State licensure actions include licensure revocation and suspension and denial of licensure renewal and licensure surrender under certain circumstances.  See 42 USC §1320a-7 and §1320c-5 for additional information regarding qualifying events.  Because excluded individuals may not receive payment from federal healthcare programs for any service they provide, a nurse appearing on the LEIE may not be employable by certain entities.

A nurse may seek to be removed from the LEIE by filing a written request with the OIG.  The OIG will evaluate the request and notify the individual in writing of its final decision.  The reinstatement process may take up to 120 days to complete, and in some cases, longer.  If an individual is denied reinstatement, the individual may reapply after 1 year has elapsed.

Texas Exclusions List

A nurse who has received a disciplinary order from the Texas Board of Nursing may also appear on the Texas Exclusions List.  The Texas Exclusions List is maintained by the Texas Office of Inspector General (OIG).  The OIG may prevent certain individuals and businesses from acting as service providers and receiving funds from Medicaid and other state programs.   For example, an individual receiving an adverse action from a licensing board, such as the Board of Nursing, may be placed on the Texas Exclusions List.  Adverse actions include licensure revocation, suspension, and surrender.  See 1 TAC §371.1705 and §371.1707 for additional information regarding qualifying events. 

Placement on the Texas Exclusions List may affect a nurse’s ability to obtain employment, as service providers are prohibited from receiving payment for services provided by an excluded individual.
