The Texas Board of Nursing submits all proposed rule changes to the Texas Register, a weekly publication that serves as the notice bulletin of state agency rulemaking. The Texas Board of Nursing (Board) proposes amendments to §217.23, concerning Balance Billing Dispute Resolution.

In the December 3, 2019, edition of the Texas Register:

The Texas Board of Nursing (Board) proposes amendments to §216.8, concerning Relicensure Process. The amendments make conforming changes to the section for consistency with §216.3, which was amended by the Board and published in the Texas Register on November 15, 2019.

The Board also proposes amendment to §217.3, concerning Temporary Authorization to Practice/Temporary Permit.

The Board also proposes amendments to §217.5, concerning Temporary License and Endorsement. The amendments implement the requirements of Senate Bill (SB) 1200, enacted by the 86th Texas Legislature, effective September 1, 2019.

  • The Texas Board of Nursing (Board) proposes amendments to §217.9, concerning Inactive and Retired Status. The amendments clarify that a nurse whose license is in "retired" status may not engage in the practice of nursing. While a volunteer retired nurse may practice nursing in compliance with the limitations of §217.9(e), a nurse whose license is in "retired" status may not.  Written comments are due by December 31, 2017.   • The Texas Board of Nursing (Board) proposes amendments to §223.1, concerning Fees. The amendments are proposed under the authority of the Occupations Code §301.151 and §301.155 and are necessary to comply with budgetary requirements established by the Texas Legislature. The proposed amendments will reduce each current level of licensure renewal by $10, thereby making the new renewal fee for a vocational nurse license $45; the renewal fee for a registered nursing license $60; and the renewal fee for an advanced practice registered nursing license $50.

Rule Hearing Thursday, July 3, 2014
  • The Texas Board of Nursing (Board) is holding a public hearing on Thursday, July 3, 2014, to receive public comments on proposed new Chapter 221, §§221.1-221.15, relating to Advanced Practice Registered Nurses, as was published in the Texas Register on May 30, 2014 (39 TexReg 4101-4118). This hearing is designed to provide an opportunity for nurses and others to comment on the proposed new chapter.
  • The hearing will take place on Thursday, July 3, 2014, from 1:00 PM - 3:00 PM, or until all comments are received, if sooner, in Room 100, in the William P. Hobby Building, located at 333 Guadalupe, Austin, Texas 78701.
  • Proposed new Chapter 221, §§221.1-221.15, relating to Advanced Practice Registered Nurses, may be viewed in the May 30, 2014, edition of the Texas Register, located at:

  • The Board appreciates all stakeholder participation and feedback on the proposed new rule. In the June 6, 2014, Texas Register:
  • The Texas Board of Nursing (Board) proposes new §213.35 pertaining to Knowledge, Skills, Training, Assessment and Research (KSTAR) Pilot program.  The new rule is proposed under the authority of the Occupations Code §301.1605(a) and §301.453. The new rule will effectuate a two-year pilot program designed to evaluate the use of individualized competency assessments and targeted remediation plans as a form of disciplinary action for nursing practice violations of the Nursing Practice Act (NPA). The KSTAR pilot disciplinary orders may be offered as an alternative to conventional disciplinary sanctions of warning with probationary stipulations as authorized by §301.453 of the Occupations Code under appropriate circumstances. The pilot will permit the evaluation of this alternative form of discipline to determine if individualized competency assessments combined with a designed remedial plan can effectively address competency questions and reduce the need for extended probation and monitoring of disciplined nurses.   • The Texas Board of Nursing (Board) proposes the repeal of Chapter 221, §§221.1 -221.4 and §§221.6 -221.17, concerning Advanced Practice Nurses. This repeal is neces¬sary because the Board is proposing a new chapter concerning advanced practice registered nurses (APRNs). The proposed new chapter, 22 TAC Chapter 221, §§221.1 -221.15, reorganizes and/or clarifies the existing provisions of Chapter 221, codifies existing Board policy in rule, and aligns the chapter's provisions with the APRN Consensus Model (Consensus Model) and the National Council State Board of Nursing (NCSBN) model rules.   • The Texas Board of Nursing (Board) proposes amendments to §213.32, concerning Corrective Action Proceedings and Schedule of Administrative Fines. The amendments are proposed under the authority of the Occupations Code Chapter 301, Subchapter N and §301.151, as well as the general authority of Senate Bill (SB) 1415, enacted by the 81st Legislature, Regular Session, effective September 1, 2009, and SB 1058, enacted by the 83rd Legislature, Regular Session, effective September 1, 2013, and are necessary to specify additional types of violations for which a corrective action may be imposed.   • The Texas Board of Nursing (Board) proposes amendments to §213.34, concerning Deferred Disciplinary Action Pilot Program. The amendments are proposed under the authority of the Occupations Code Chapter 301, Subchapter N and §301.151, as well as the general authority of Senate Bill (SB) 1415, enacted by the 81st Legislature, Regular Session, effective September 1, 2009, and SB 1058, enacted by the 83rd Legislature, Regular Session, effective September 1, 2013, and are necessary for consistency with the newly enacted legislation and to implement deferred discipline as a permanent disciplinary option under the Board's rules.   • The Texas Board of Nursing (Board) proposes amendments to §214.9, concerning Program of Study. The amendments are proposed under the authority of the Occupa-tions Code §301.151 and §301.157(b) and are necessary to clarify two of the existing provisions of the section regarding major curriculum changes and eligibility for new program proposals.   • The Texas Board of Nursing (Board) proposes new Chapter 227, pertaining to Pilot Programs for Innovative Applications to Vocational and Professional Nursing Education, §§227.1 -227.4. The new chapter is proposed under the authority of the Occupations Code §301.151 and §301.1605 and establishes the procedures and requirements that apply to pilot programs for innovative applications to vocational and professional nursing education.   • The Texas Board of Nursing (Board) proposes the repeal of existing Chapter 227, §§227.1 -227.6, concerning Pilot Programs for Innovative Applications to Professional Nursing Education. The Board is simultaneously proposing new Chapter 227, concerning Pilot Programs for Innovative Applications to Vocational and Professional Nursing Education, that reorganizes the provisions of the chapter, applies the provisions of the chapter to both professional and vocational nursing education programs, and establishes the requirements and procedures that will apply to pilot programs for innovative applications to professional and vocational nursing education.   • The Texas Board of Nursing proposes new section 228.1, pertaining to Pain Management. The new section is proposed under the authority of the Occupations Code §§157.0511(b), 168.002, 168.201, 301.002, 301.151, 301.452, 301.453, and 301.4531, as well as the general authority of Senate Bill (SB) 406 (83rd Legislature, Regular Session, effective November 1, 2013); House Bill (HB) 1803 (83rd Legislature, Regular Session, effective January 1, 2014); and SB 1643 (83rd Legislature, Regular Session, effective September 1, 2013), and prescribes the minimum standards of nursing practice for an advanced practice registered nurse (APRN) who provides pain management services.   • The Texas Board of Nursing also proposes amendments to Chapter 216, §§216.1 -216.3 and 216.5 216.11. These amendments are proposed under the authority of the Occupations Code §§301.151, 301.303, 301.305, 301.306, and 301.307 and the Health and Safety Code §323.004(b-1) and §323.0045 and are necessary to implement the requirements of Senate Bill SB) 1058 and SB 1191, both enacted by the 83rd Texas Legislature, Regular Session, and effective September 1, 2013. The proposed amendments also amend the definition of the term "advanced practice registered nurse" for consistency with the Advanced Practice Registered Nurse Consensus Model of the National Council of State Boards of Nursing, correct outdated references and minor typographical errors in the rule text, and replace the term "continuing education" with "continuing nursing education" as appropriate throughout the rule text.   • The Texas Board of Nursing proposes amendments to Chapter 225, §§225.1 -225.6 and 225.8 -225.11; and new §§225.12 - 225.15. The amendments and new sections are necessary in order to renumber the chapter sections and result in adding a new §225.15, concerning RN Delegation to Unlicensed Personnel and Tasks not Requiring Delegation in Independent Living Environments for Clients with Stable and Predictable Conditions.   • The Texas Board of Nursing (Board) proposes amendments to §211.7, concerning Executive Director. The amendments are proposed pursuant to the Occupations Code §301.101, 301.151, 301.452, 301.453, and 301.467 and authorize the Board's Executive Director to approve and accept certain Board Orders on behalf of the Board, without Board ratification.
  • The Texas Board of Nursing (Board) proposes amendments to §213.3, relating to Pleading. The amendments are proposed pursuant to the Government Code §2001.054 and the Occupations Code §301.151, 301.452, 301.453, 301.454, and 301.458 and are necessary to: (i) implement the provisions of Senate Bill (SB) 1058, which was enacted by the 83rd Texas Legislature, Regular Session, effective September 1, 2013; and (ii) clarify the Board's existing procedural requirements relating to licensure and eligibility matters.
  • The Texas Board of Nursing (Board) proposes an amendment to §216.3, relating to Requirements. The amendment is proposed pursuant to the Occupations Code §157.0511, 301.151, 301.152, and 301.303 and requires advanced practice registered nurses (APRNs) who prescribe controlled substances to complete an additional 3 hours of continuing education related to prescribing controlled substances each biennium. The proposed amendment is necessary for consistency with the requirements of proposed new Chapter 222, relating to Advanced Practice Registered Nurses with Prescriptive Authority, published in the Texas Register.

  • The Texas Board of Nursing (Board) proposes amendments to §214.3, concerning Program Development, Expansion and Closure. The amendments are proposed under the Occupations Code §301.155(a), 301.157, and 301.151 and establish, in rule, a $500 filing fee for an out-of-state vocational nursing education program seeking to conduct clinical learning experiences in Texas; and clarify that the Board may withdraw the approval of any out-of-state vocational nursing education program that fails to maintain the requirements necessary for initial approval to conduct clinical learning experiences in Texas.
  • The Texas Board of Nursing (Board) proposes amendments to §215.3, concerning Program Development, Expansion and Closure.  The amendments are proposed under the Occupations Code §301.155(a), 301.157, and 301.151 and establish, in rule, a $500 filing fee for an out-of-state professional nursing education program seeking to conduct clinical learning experiences in Texas; and clarify that the Board may withdraw the approval of any out-of-state professional nursing education program that fails to maintain the requirements necessary for initial approval to conduct clinical learning experiences in Texas.
  • The Texas Board of Nursing (Board) proposes the repeal of Chapter 222, §222.1 -222.12, concerning Advanced Practice Registered Nurses with Prescriptive Authority. The Board is simultaneously proposing a new chapter concerning advanced practice registered nurses (APRNs) with prescriptive authority in order to implement the provisions of Senate Bill (SB) 406, which was enacted by the 83rd Texas Legislature, Regular Session, effective November 1, 2013.
  • The Texas Board of Nursing (Board) proposes new Chapter 222, §222.1 -222.10, concerning Advanced Practice Registered Nurses with Prescriptive Authority. The new chapter is proposed under the authority of the Occupations Code Chapter 157 and §301.151, 301.152, 301.452, 301.453, and 301.4531 and is necessary to implement Senate Bill (SB) 406, which was enacted by the 83rd Texas Legislature, Regular Session, effective November 1, 2013.

  • The Texas Board of Nursing (Board) adopts, on an emergency basis, amendments and new paragraphs to §213.32, concerning Schedule of Administrative Fine(s), to take effect on September 1, 2009. The 81st Texas Legislature, Regular Session, enacted Senate Bill (SB) 1415, which adds new Subchapter N to the Occupations Code Chapter 301. SB 1415 authorizes the Board to impose a corrective action, which is a non-disciplinary action consisting of a fine, remedial education, or any combination of a fine or remedial education, on an individual who violates a provision of Chapter 301 or a rule or order adopted under Chapter 301. SB 1415 requires the Board to adopt, by rule, guidelines for the types of violations for which a corrective action may be imposed under new Subchapter N. SB 1415 becomes effective on September 1, 2009. Rule language can also be downloaded from this link: TAC section 213.32.

The proposed amendments and repeal are necessary for the purpose of aligning 22 TAC Chapter 221 with Chapter 305 of the Nursing Practice Act (the Advanced Practice Registered Nurse (APRN) Compact) and national standards.
